Spousal Support / Alimony

Los Angeles Spousal Support Attorneys

California courts refer to alimony as “spousal support”. Spousal support may be granted to either a husband or wife, and California law is gender neutral in this area.

Generally, spousal support is tax deductible by the payor and includable as income to the payee. On the other hand, child support is neither tax-deductible by the payor nor includable as income to the payee.

There are numerous factors to be considered in determining an appropriate award of spousal support.    Such factors include:

1)     The length of the marriage.

2)     The age and health of each spouse.

3)     Each spouse’s ability to earn income and their ability to be self-supporting based upon their past work experience and education.

4)    The assets and obligations of each party.

5)    Whether there has been domestic violence in the relationship.

Spousal support is one of the areas in which a California court has the most discretion.
